These Terms and Conditions ("Terms") are a binding agreement between you and Tackle ("Tackle," "we," "us," or "our"). They govern your use of the Tackle app for customers, the Tackle Pro app for service providers (both on iOS and Android), the website at quicktackle.com, and any related features, communications, and support (together, the "Services").
By creating an account, joining the early access list, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
IMPORTANT: SECTION 21 CONTAINS AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. UNLESS YOU OPT OUT WITHIN 30 DAYS, MOST DISPUTES BETWEEN YOU AND TACKLE WILL BE RESOLVED BY INDIVIDUAL ARBITRATION, NOT IN COURT, AND YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
1. About Tackle
Tackle is an online marketplace for small home jobs in New York City. Customers describe a job, approve a suggested price, and are matched with an independent local service provider ("Pro") who accepts the job.
Tackle is a technology platform. Tackle does not perform home services, does not employ Pros, and does not supervise, direct, or control how Pros perform their work.
The service contract is between the Customer and the Pro. When a Pro accepts a job, the Customer and the Pro enter into an agreement directly with each other for that job, on the terms shown in the job confirmation. Tackle is not a party to that agreement.
Pros are independent businesses. They choose which jobs to accept, when to be available, and how to perform the work, and they use their own tools and skills.
2. Definitions
"Customer" means a user who requests a job through the Tackle app.
"Pro" means an approved independent service provider who accepts jobs through the Tackle Pro app.
"Job" means a specific home service requested by a Customer and accepted by a Pro.
"Job Price" means the price approved by the Customer for a Job, including any approved price change.
"Membership" means the paid monthly subscription that gives a Pro access to receive and accept Jobs.
"User Content" means descriptions, photos, messages, reviews, and other material you submit through the Services.
3. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract.
Customers must request Jobs only for property they own, rent, or are authorized to arrange work at.
You must give accurate and complete information and keep it current.
You may keep only one Customer account and one Pro account. Accounts are personal and may not be sold, shared, or transferred.
You are responsible for all activity under your account. Keep your password private and tell us right away at james@quicktackle.com if you suspect unauthorized access.
The Services are available only in the parts of New York City that Tackle has opened. Availability may vary by neighborhood and may change.
4. Services Offered
At launch, Customers may request Jobs in these categories: Lighting and Bulbs; Smoke and CO Detectors; Window AC Install and Removal; Lawn Care and Planter Maintenance; Small Repairs; Home Maintenance; and Household Help. Customers may also describe a job under "Something Else," which Tackle may accept, reclassify, or decline. Tackle may add, change, or remove categories at any time.
5. Requesting and Booking a Job (Customers)
Describe the job. Choose a category, describe the job in your own words, add photos, and give the address, preferred date and time, and urgency. Your description and photos must be accurate and complete. Do not leave out details that affect the size, safety, or difficulty of the work.
Review the suggested price. Tackle suggests a price with an itemized breakdown. The price starts from a base rate for the service and may adjust for the number of items, ladder or high-ceiling work, heavy or bulky items, and urgency (for example, a surcharge for same day or ASAP requests). The price never goes below the minimum or above the maximum set for that service. Any applicable New York State and City sales tax is shown in the breakdown before you confirm.
Approve the price. Nothing is booked until you approve the price and add a valid payment method.
Get matched. Tackle offers your Job to eligible Pros. The Job is booked when a Pro accepts it. You will receive a job confirmation in the app and by email showing the service, the Pro, the Job Price, the date and time, and the cancellation terms. That confirmation forms the written agreement between you and the Pro.
Track the job. Follow the Job through each status until it is marked Completed.
About price suggestions. Suggested prices and categories are generated with help from automated tools and Tackle's pricing rules. They are estimates based on the information you provide, not a guarantee that the job is exactly as described.
Customer responsibilities. You must give the Pro safe, reasonable access to the job location at the scheduled time; secure pets; tell the Pro about known hazards; obtain any permission needed from your landlord, building management, co-op, or condo board; and make sure an adult aged 18 or older is present for the Job unless you and the Pro agree otherwise in chat.
6. Price Changes
If a Job turns out to be larger or different than described, the Pro must stop and send a price change request in the app with the reason and the new price. The Pro may continue the additional work only after you approve the new price in the app. If you decline, the Pro may finish the work originally approved, or end the Job if the original work cannot safely be completed as described. If the Job ends because the description was materially inaccurate, a fee for the Pro's time, shown in the app, may apply. A Pro may never collect extra money outside the app.
7. Payments, Taxes, and Refunds (Customers)
Payment method. You must add a valid credit card, debit card, or other accepted payment method before booking. Payments are processed by our third-party payment processor, and you authorize it to charge your payment method as described in these Terms.
When you are charged. We place a temporary authorization on your payment method when the Job is booked. You are charged only after the Pro marks the Job complete. The final charge is the Job Price, plus any approved price change, any applicable tip you choose to add, and any applicable taxes. A receipt is sent to your email.
Pros keep the full Job Price. Tackle does not take a commission from Job payments. Tackle collects payment on the Pro's behalf as the Pro's limited payment collection agent, and your payment to Tackle satisfies your payment obligation to the Pro.
Tips. Tips are optional and go 100% to the Pro.
Pay through Tackle only. All payments for Jobs found through the Services must be made through the Services. Do not pay cash or use other apps for a Job booked on Tackle.
Problems with a Job. If a Job was not completed as agreed, report it from the job screen within 72 hours of completion. We will review the report, the photos, and both parties' accounts, and may issue a full or partial refund where appropriate. Refunds go back to the original payment method.
Failed payments. If a charge fails, we may retry it and may restrict your account until the balance is paid.
8. Cancellations and No-Shows
Customer cancellations. You may cancel free of charge at any time until the Pro's status changes to En Route. Once the Pro is En Route, a late cancellation fee shown in the app before you confirm the cancellation may apply, and is paid to the Pro.
Customer no-show. If the Pro arrives on time and cannot access the job location or reach you within 15 minutes, the Pro may mark the Job as a Customer no-show and the late cancellation fee may apply.
Pro cancellations. If a Pro cancels or does not arrive, you will not be charged, and we will try to match your Job with another eligible Pro.
Pro reliability. Pros are expected to complete every Job they accept. Repeated late cancellations, no-shows, or late arrivals may lower a Pro's visibility in matching or lead to suspension.
Weather and safety. Either party may reschedule or cancel without a fee if the Job cannot be done safely, for example outdoor work during severe weather.
9. Damage and Disputes
Pro responsibility. Pros are independent contractors and are responsible for any damage they cause to property while performing a Job.
How to report. Customers must report damage from the job screen within 72 hours of the Job being marked complete, with photos of the damage.
Our review. We will ask the Pro for their account and their completion photos. Our team will contact both parties within one business day to help reach a resolution, which may include repair by the Pro, reimbursement by the Pro, or other steps the parties agree on.
Tackle's role. Tackle helps the parties communicate and may share relevant records with them. Tackle is not an insurer and does not guarantee payment for damage caused by a Pro. Nothing in this Section limits any legal rights a Customer has against a Pro.
Consumer complaints. Customers in New York City may also contact the NYC Department of Consumer and Worker Protection by calling 311 or visiting nyc.gov/dcwp.
10. Becoming a Pro
Application. Applicants must be 18 or older, provide a valid government issued photo ID (front and back), take a selfie that we match to the ID, and provide accurate profile, service category, and service area information.
Screening. Tackle screens applicants in stages, as described in Section 6 of our Privacy Policy. Any review of criminal history happens only after a conditional approval and only with the applicant's separate written authorization, and follows the New York City Fair Chance Act and Article 23-A of the New York Correction Law. Applicants who receive a notice that Tackle may withdraw a conditional approval will have at least five business days to respond.
Approval. Review usually takes one to two business days after all required information is received. Tackle may approve or decline applications in line with applicable law.
Insured badge. Liability insurance is optional but strongly recommended. Pros who upload a current certificate of general liability insurance receive an "Insured" badge, and must keep it current or the badge will be removed.
11. Pro Obligations
Independent contractor status. You are an independent business, not an employee, partner, joint venturer, or agent of Tackle. You are not entitled to wages, overtime, benefits, or workers' compensation from Tackle. You control your schedule, which Jobs you accept, and how you perform them. You are responsible for your own tools, materials (unless the Customer supplies them), transportation, expenses, and insurance.
Taxes. You are responsible for reporting and paying all taxes on your earnings. Tackle may issue tax forms such as Form 1099-K where required by law, and may collect your taxpayer information for that purpose.
Licenses. You must hold every license, permit, and registration required for the work you accept. In particular:
NYC Home Improvement Contractor license. New York City requires a Home Improvement Contractor license from the NYC Department of Consumer and Worker Protection for residential repair, replacement, or improvement work valued at more than $200 (labor plus materials). You must not accept a Job that requires this license unless you hold a current license, and you must add your license number to your profile. Tackle may limit such Jobs to licensed Pros.
Licensed trades. You must not perform work that New York City law reserves for licensed electricians, licensed plumbers, or other licensed trades unless you hold that license.
Performing the Job. Review the Job details before accepting. Arrive within the scheduled window. Update the Job status accurately: Accepted, Scheduled, En Route, Arrived, In Progress, and Completed. Work safely and professionally, follow building rules, clean up the work area, and upload completion photos when asked.
Window AC units. Install window air conditioners securely, using proper brackets or supports, and in line with the NYC Building Code, manufacturer instructions, and building rules.
Customer information. Use Customer information only to complete the Job. Do not keep, copy, sell, or use it for any other purpose, and do not contact Customers outside the app for a Job booked on Tackle.
Payouts. You receive 100% of the Job Price and any tips, paid out to the bank account you designate on the payout schedule shown in the Tackle Pro app.
Standards. Tackle may lower visibility, suspend, or remove Pros whose ratings, reliability, licensing, or conduct fall below marketplace standards.
12. Pro Membership and Automatic Renewal
Membership required. Pros need an active Membership to receive and accept Jobs. Tackle charges no commission on Jobs and no per-lead fees.
Price. Pro Monthly costs $19 per month. The Founding Member offer costs $15 per month for the first 3 monthly billing periods, then $19 per month, and is limited to the first 200 New York City Pros. Applicable taxes may be added.
AUTOMATIC RENEWAL. YOUR MEMBERSHIP RENEWS AUTOMATICALLY EVERY MONTH, AND YOUR PAYMENT METHOD WILL BE CHARGED THE THEN CURRENT MONTHLY PRICE ON EACH RENEWAL DATE UNTIL YOU CANCEL. Before you subscribe, we show you the price, the billing frequency, the renewal terms, and how to cancel, and we ask for your consent. After you subscribe, we send you an acknowledgment by email that includes these terms and how to cancel.
How to cancel. Cancel online at any time in the Tackle Pro app under Profile, then Membership, then Cancel Membership, or by emailing help@tackle.app with the subject "Cancel Membership." Cancellation takes effect at the end of your current billing period, and you keep access until then. You will not be charged again after you cancel.
Refunds. Membership fees already charged are non-refundable, except where required by law or where Tackle charged you in error.
Price changes. We will give you at least 30 days' notice by email and in-app before any change to your Membership price or renewal terms, along with instructions on how to cancel.
Failed payments. If a Membership charge fails, your access to new Jobs is paused until payment is updated. You remain responsible for completing Jobs you already accepted.
13. Jobs That Are Not Allowed
The following may not be requested, accepted, or performed through the Services:
Electrical wiring, circuit, panel, or outlet work, gas line or gas appliance work, and plumbing work that requires a licensed professional, unless the Pro holds that license.
Asbestos, lead paint, mold remediation, pest extermination, or work with hazardous materials.
Structural, roofing, scaffolding, facade, or major renovation work, or work that requires a NYC Department of Buildings permit.
Work on fire suppression or building-wide fire alarm systems (individual smoke and CO detector battery replacement and testing is allowed).
Childcare, personal care, medical tasks, or the transport of people.
Any activity that is illegal, unsafe, or violates building rules.
Tackle may remove any Job that violates this Section, and a Pro may decline or stop any Job they believe is unsafe.
14. Rules for All Users
You agree that you will not:
Give false or misleading information, impersonate anyone, or create fake accounts, Jobs, or reviews.
Harass, threaten, abuse, or act violently toward any user or Tackle staff.
Discriminate against anyone on the basis of any characteristic protected by the New York State Human Rights Law or the New York City Human Rights Law, including race, color, religion, national origin, citizenship or immigration status, sex, gender identity or expression, sexual orientation, age, disability, marital or partnership status, caregiver status, and height or weight.
Use in-app chat for anything other than coordinating a Job, or share personal contact details to move a Job off the platform.
Arrange or pay for a Job found through Tackle outside the Services.
Use the Services while impaired by alcohol or drugs.
Upload content that is unlawful, misleading, obscene, hateful, or infringes anyone's rights, including photos of people who have not agreed to be photographed.
Copy, scrape, reverse engineer, disrupt, or overload the Services, or try to access accounts or systems without permission.
Use the Services to break any law.
15. Ratings, Reviews, and User Content
Reviews. Customers and Pros may rate and review each other after a Job. Reviews must be honest, relate to a real Job, and follow these Terms. You may not offer or accept anything of value in exchange for a review, or post a review of yourself.
Ownership and license. You keep ownership of your User Content. You give Tackle a worldwide, non-exclusive, royalty-free, transferable license to host, store, use, reproduce, display, and process your User Content to operate, improve, and promote the Services. We will not use photos of the inside of your home in marketing without your separate consent.
Moderation. Tackle may review, hide, or remove reviews or content that break these Terms, but is not required to monitor all content. You can report a review from the review screen.
16. Intellectual Property
The Services, including the Tackle name and logo, the apps, website, software, designs, and text, belong to Tackle and are protected by intellectual property laws. Tackle grants you a limited, revocable, non-exclusive, non-transferable license to install and use the apps on devices you own or control, for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Services without our written permission. If you send us feedback or ideas, we may use them without any obligation to you.
17. Third-Party Services and App Stores
The Services rely on third parties such as our payment processor, maps, identity verification, background screening, and app stores. Your use of their services is subject to their terms.
Apple App Store. If you downloaded our apps from the Apple App Store: (a) these Terms are between you and Tackle only, not Apple; (b) Apple has no obligation to provide maintenance or support for the apps; (c) if an app fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price, if any, and Apple has no other warranty obligation; (d) Apple is not responsible for addressing any claims relating to the apps, including product liability, legal compliance, or intellectual property claims; and (e) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of restricted parties.
Google Play. If you downloaded our apps from Google Play, your use is also subject to the Google Play Terms of Service.
18. Suspension and Termination
You may close your account at any time in the app settings or by emailing james@quicktackle.com. Tackle may suspend, restrict, or close any account, cancel any Job, or remove any content if we reasonably believe you have broken these Terms or the law, created a safety risk, or harmed other users or Tackle. Where appropriate, we will tell you the reason and give you a chance to respond. Sections that by their nature should continue after termination, including payment obligations, damage responsibilities, disclaimers, limitation of liability, indemnification, and dispute resolution, will continue.
19. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TACKLE DOES NOT WARRANT THE QUALITY, SAFETY, TIMING, OR LEGALITY OF ANY JOB, THE ACCURACY OF ANY USER CONTENT, OR THE CONDUCT OF ANY USER. IDENTITY VERIFICATION AND BACKGROUND SCREENING HAVE LIMITS AND DO NOT GUARANTEE A PRO'S CONDUCT OR SKILL. SUGGESTED PRICES ARE ESTIMATES ONLY. WE DO NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE.
20. Limitation of Liability and Indemnification
TO THE FULLEST EXTENT PERMITTED BY LAW, TACKLE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PROPERTY DAMAGE, OR PERSONAL INJURY ARISING FROM ANY JOB OR ANY USER'S CONDUCT. TACKLE'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO TACKLE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under New York law, including liability for Tackle's own gross negligence, willful misconduct, or fraud.
You agree to defend, indemnify, and hold harmless Tackle and its owners, officers, employees, and agents from any claims, losses, damages, and expenses, including reasonable attorneys' fees, arising from your use of the Services, your User Content, your violation of these Terms or the law, or, if you are a Pro, any Job you perform.
21. Dispute Resolution, Arbitration, and Class Action Waiver
Informal resolution first. Before starting any claim, you agree to email james@quicktackle.com with a description of the dispute and give us 30 days to try to resolve it informally. We will do the same before starting a claim against you.
Binding individual arbitration. Any dispute between you and Tackle arising from or relating to these Terms or the Services that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in New York County, New York, or by video or written submissions if you prefer. Tackle will pay the AAA filing, administrative, and arbitrator fees for any claim you bring for less than $10,000, unless the arbitrator finds the claim frivolous. The Federal Arbitration Act governs this Section.
Exceptions. Either party may bring an individual claim in small claims court in New York City if it qualifies, and either party may seek a court order to stop misuse of intellectual property.
Class action waiver. You and Tackle may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may award relief only to the individual party.
30-day opt-out. You may opt out of this arbitration agreement by emailing james@quicktackle.com with the subject "Arbitration Opt-Out" and your name and account email within 30 days after you first accept these Terms. Opting out does not affect any other part of these Terms.
Disputes between Customers and Pros. This Section governs disputes with Tackle only. Disputes between a Customer and a Pro are between those parties.
22. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules, and by the Federal Arbitration Act for Section 21. Any claim not subject to arbitration must be brought in the state or federal courts located in New York County, New York, and you and Tackle consent to their jurisdiction.
23. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date shows when they last changed. If we make a material change, we will notify you by email, in-app notice, or on our website at least 15 days before it takes effect. If you do not agree, you may close your account before the change takes effect. Continued use after that date means you accept the updated Terms.
24. General Terms
Entire agreement. These Terms, the Privacy Policy, and any terms shown at the time of a Job or Membership purchase are the entire agreement between you and Tackle about the Services.
Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
No waiver. Our failure to enforce a right is not a waiver of that right.
Assignment. You may not transfer these Terms without our written consent. We may transfer them in connection with a merger, acquisition, or sale of assets.
Notices. We may send notices to the email address on your account or through the app. You may send notices to james@quicktackle.com.
Events beyond our control. Tackle is not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, power or internet outages, or government action.
